End-User License Agreement for

MasterOPCTM, a computer program

 

IMPORTANT - READ CAREFULLY

This End-User License Agreement ('EULA') is a legal agreement between you (either a legal or a natural person that justly purchased a license for using MasterOPCTM, a computer program ('MasterOPCTM')) and the MasterOPCTM exclusive right holder (registration number 2012619442, 'RIGHT HOLDER').

MasterOPCTM includes a set of programs of various functional compositions, written to the respective media or uploaded to the Internet for downloading, an USB dongle (if it is included into a delivery kit), and electronic documentation or/and printed materials.

By installing, copying, executing or otherwise using MasterOPCTM, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, RIGHT HOLDER is unwilling to license MasterOPCTM to you, or may terminate this EULA.

 

LICENSE for MasterOPCTM

MasterOPCTM is an ownership of RIGHT HOLDER. MasterOPCTM is protected by international copyright laws and copyright treaties as well as by other intellectual property laws and treaties. MasterOPCTM is licensed, not sold.

GRANT OF LICENSE. This EULA grants you the following rights.

* Program. You may install and use one MasterOPCTM license on one computer. To provide this, a program may be protected by a USB dongle or by codes of program activation. A program works only on that computer where the respective dongle is mounted or initial activation is performed.

* Licensing conditions. MasterOPCTM is provided «as is». That is, by using MasterOPCTM, you agree that MasterOPCTM can contain both program code errors and algorithm errors. The entire risk concerned with ability or inability of using MasterOPCTM is with you.

* Storing and copying. You may make copies of MasterOPCTM from physical media MasterOPCTM is written onto, and store them on a hard disk of a computer or a network server, as well as on any other physical media exclusively for back-up purposes in case of the original media fail.

* MasterOPCTM transfer or sale. You may permanently transfer all of your rights under this EULA, provided you retain no copies, you transfer all of MasterOPCTM (including all component parts, the media and printed materials, any upgrades or/and updates, and this EULA). If MasterOPCTM is an upgrade or an update, any transfer must include all prior versions of MasterOPCTM. Sale of free-of-charge MasterOPCTM versions is inadmissible.

* Technical support. RIGHT HOLDER authorizes the MPS Soft company (‘MPS Soft’) to provide MasterOPCTM technical support. According to the limited warranty described below, MPS Soft warrants technical support only to those legal or natural persons that either justly purchased MasterOPCTM, or concluded with MPS Soft a technical support treaty. RIGT HOLDER reserves to oneself all of rights that are not expressly granted to you according to this EULA.

LIMITATIONS. This EULA imposes on you the following restrictions.

* Copyright. MasterOPCTM (including built-in examples of usage, electronic documentation and printed materials, graphic and interface realization) is a copyright subject and protected by international copyright laws and copyright treaties as well as by other intellectual property laws and treaties. Copying of printed materials accompanying MasterOPCTM is FORBIDDEN.

* Network use. Two or more computers can simultaneously use the same MasterOPCTM kit only if the MasterOPCTM configuration you purchased expressly provides this. This condition does not concern of means for development of extension programs for MasterOPCTM.

* Reverse-engineering, decompilation and disassembly. Reverse-engineering, decompilation and disassembly of MasterOPCTM are FORBIDDEN.

* Changing of composition. Use of MasterOPCTM is permitted only in the composition of modules and functions, for which this license was purchased. Steps to change this composition are FORBIDDEN.

* MasterOPCTM division. MasterOPCTM is licensed as a united product. Component parts of MasterOPCTM may not be used on several computers. The exception is the original texts, which in MasterOPCTM expressly spelled out that they intended to develop stand-alone custom software solutions.

* Rental. You may not rent or lease MasterOPCTM.

* Protection bypass. If MasterOPCTM is protected by a dongle, attempts to crack or bypass the protection (that is, attempts to launch MasterOPCTM without a dongle) are FORBIDDEN. If MasterOPCTM is protected by program activation codes, attempts to crack or bypass the protection (that is, attempts to launch MasterOPCTM without license activation) are FORBIDDEN.

* Agreement termination. This EULA is automatically terminated if you violate any condition of this EULA. In such a case, you must destroy all copies of MasterOPCTM and all of its component parts.

 

Limited Warranty for

MasterOPCTM, a computer program

Purchasing MasterOPCTM a legal way, the end user receives a limited warranty, and also gets the right to a technical support agreement (Coupon) that also provides the right to limited warranty. Limited warranty is available only if the registration card attached to MasterOPCTM is filled in and sent to MPS Soft by email (sales@masterscada.ru).

* Limited warranty. MPS Soft warrants that MasterOPCTM will perform substantially in accordance with the accompanying written documentation, and physical media and a dongle will be free from physical defects for a period of 1 (one) year after delivery.

* MPS Soft liability. The entire risk concerned with ability or inability to use MasterOPCTM, accompanying documentation or technical support is with the end user. MPS Soft liability for breakage comes to repair or replacement of MasterOPCTM or its component parts that do not meet requirements of this limited warranty, if MasterOPCTM or its component parts are returned back to MPS Soft along with copies of documents confirmed that MasterOPCTM is purchased justly. This limited warranty is not valid if a damage of MasterOPCTM or its component part is a result of improper handling, incorrect use or an accident. Any component parts of MasterOPCTM, which are received as replacements according to this limited warranty, are warranted for the longest period from the two ones: 1) 30 days 2) a period up to the initial warranty period is expired.

* NO LIABILITY FOR CONSEQUENTIAL DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RIGHT HOLDER OR ITS REPRESENTATIVE MPS Soft BE LIABLE FOR PERSONAL INJURY, OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFIT, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS), ARISING OUT OF THE USE OF, OR INABILITY TO USE, THIS PRODUCT, EVEN IF RIGHT HOLDER OR ITS REPRESENTATIVE MPS Soft HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

* EXCLUSION OF OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MPS Soft EXPRESSLY DISCLAIMS ANY OTHER WARRANTY FOR MASTEROPCTM. EXCEPT AS PROVIDED ABOVE, MASTEROPCTM AND ANY RELATED DOCUMENTATION ARE PROVIDED WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

* Technical support. Technical support is available during the period of validity of your Coupon for MasterOPCTM technical support and subject to the conditions set out in this Coupon.

* Extended technical support. Extended technical support may be provided under a separate contract during the period of the limited warranty. Extended technical support includes telephone consultations and/or consultation on the MPS Soft territory and/or shortened response time to enquiries by email.

 

 

       

The demo version of Modbus OPC Server supports 32 tags at the most. A server operation time is not limited (both in the design and run-time modes).

The Simulator Mod_RSSim

The simulator MODBUS RTU, TCP/IP and Allen Bradley DF1 PLC Simulator (Mod_RSSim) is used and distributed on base of the license GPL v3 according to the rules established by Conrad Braam, the program author:
